Virginia small claims are filed in the General District Court and cover disputes up to $5,000. Attorneys are permitted. For claims between $5,001 and $25,000, Virginia has an intermediate Civil Division that is faster than Circuit Court. Virginia has a 5-year statute of limitations for written contracts and 3 years for oral contracts. Filing fees vary by court. Losing parties may appeal to the Circuit Court for a new trial.
