About Nebraska Small Claims Court
Nebraska's County Court Small Claims division covers disputes up to $7,500 as of July 1, 2025 (LB139 also set an intermediate $6,000 limit from July 1, 2024). Attorneys are prohibited at hearings. Nebraska has a 5-year statute of limitations for written contracts and 4 years for personal injury — both above average. The $29 flat filing fee is among the cheapest in the nation. Cases are heard by a county court judge. Losing parties may appeal to District Court, where attorneys are then permitted.
