About Idaho Small Claims Court

Idaho's Magistrate Division Small Claims Department handles disputes up to $5,000. Attorneys are not permitted to represent regular parties at hearings. The $69 flat filing fee is moderate. Idaho has a 5-year statute of limitations for written contracts and 4 years for oral contracts — both longer than many states. Cases are filed in the county where the defendant resides or where the transaction occurred. Collection agencies, however, must be represented by an attorney if they appear.
